Advice for Purchasing Pre-need Funeral Contracts and Ossuary Niches

(I)Pre-need Contract:
1.When purchasing pre-need funeral services by means of a pre-need funeral contract, consumers are advised to select pre-need service providers that have a “certain scale” and have been trusted with pre-need funeral contract business according to the Statute for Funeral and Burial Management (please enquire local government agencies for the QVL of qualified pre-need services or look up and download the QVL of qualified pre-need services from the website of the MOI Department of Civil Affairs at http://www.moi.gov.tw/dca/download.asp?cls_id=139).
2.Consumers are strongly advised to carefully read the terms and conditions in the pre-need funeral contract to see if there are unfair terms before signing the contract. Consumers may cross-examine the pre-need funeral contract with the Standard Pre-need Funeral Contract (self-use or family use) and the Restricted Items in Standard Pre-need Funeral Contracts (self-use or family use) established by the MOI. 3.Pre-need funeral services distributed through multilevel marketing should be reported to the Fair Trade Commission.
4.Consumers are advised not to purchase a pre-need funeral contract as an investment. Instead of an investment product, the aim of pre-need funeral contracts is to provide funeral and burial services. Therefore, when there are disputes arising from or in connection with a pre-need contract, the consumer protection specified in the Consumer Protection Act will be inapplicable.
5.Other advice
(1)A pre-need funeral contract provider must reach a certain scale, that is
a.funeral homes capacitated for offering funeral services;
b.funeral homes with a paid-in capital at or over NT$30 million;
c.funeral homes without deficits in the average income after taxation in the past 3 years, and with financial reports certified by a CPA;
d.funeral homes with full-time funeral hosts within the territory of their operations; funeral homes outsourcing funeral services should report to the local competent authorities where the service providers are located and notify the local competent authorities to which the service providers are registered;
e.funeral homes with computer systems for reporting and enquiring the contents of pre-need funeral contracts, and such contents be approved by the local competent authorities according to the MOI regulations; and
f.funeral homes with standard pre-need funeral contracts containing the required items and no restricted items specified by the MOI and approved by the local competent authorities.
(2)Pre-need funeral contract sellers should entrust 75% of the contract fee according to the aim of trust.

(II)Ossuary Niche:
1.When purchasing a niche from a private ossuary, consumers are advised to find a legally registered ossuary with a special account for the niche management fee. When niches are distributed through an agent, such an agent must be a realty agent. Otherwise, the sale is illegal.
2.Consumers should verify if the private ossuary has been approved for use by the local government. Consumers can look it up from the website of the MOI Department of Civil Affairs at http://www.moi.gov.tw/dca/customs04.asp.
3.Consumers are strongly advised to read carefully the terms and conditions in the purchasing contract to see if there are unfair terms before signing the contract. Consumers may make cross examine the Standard Ossuary Niche Right Purchasing Contract established by the MOI. 4.Ossuary niches distributed through multilevel marketing should be reported to the Fair Trade Commission.
5.Consumers are advised not to purchase ossuary niches as an investment. As the supply of ossuary niches is higher than the demand and not suitable to be an investment tool. Therefore, when there are disputes arising from or in connection with the purchase, the consumer protection specified in the Consumer Protection Act will be inapplicable.
