Rights and Benefits Division

The purpose of conscription is to protect people’s life and property safety. Thus, when conscription is conducted, the government not only does its best to minimize impacts on people’s life, but also accords certain rights and favors to military personnel and their families in recognition of their sacrifice and contribution to the nation. In addition, the Department manages and recruits reserve soldiers in coordination with all levels of reserve commands of the Ministry of National Defense, and conducts management and group training of reservist draftees of substitute services in coordination with the Ministry of Interior.

I.Rights of Military Personnel
(1)Tax exemption on salaries: a serviceman who sits national examination may apply to the duty service unit (troop) for official leave as long as the absence does not affect national defense.
(2)Discounted ticket prices for public transportation (Kuo-Kuang bus) or the National Theater and Concert Hall.
(3)When being conscribed for military service, students may apply to school for “Student Status Retention certificate” or “Request to Defer Offer of Admission”. And employees may apply to employers for “Certificates for Resumption” so as to rerun to school or resume employment after retirement or discharge from military service.
(4)If a serviceman is hospitalized in military hospital for more than 7 days due to injury or sickness, the military hospital will notify the Department of Compulsory Military Service of Taipei City which will in turn sends staff to express sympathy and pay special allowance for hospitalization.
(5)If a serviceman is approved by the Ministry of National Defense as disabled, consolation payment shall be made to such serviceman according to the law. Where a dependent of the serviceman who has been listed as a dependent in distress has difficulty in maintaining an affordable life before or after the disabled serviceman is employed, living allowance shall continue to be paid during his pension collection period. In the event that the family financial status of those who have not received living allowance turns into distress during the pension collection period, they may apply for assistance. If the level of disability of a serviceman qualifies for veteran home care, he will receive proper care in a veteran home designated by him.
(6)Right issues associated with disabilities caused by injury or illness:
The level of disability should be evaluated and determined by the military prior to retirement or discharge from hospital. In order to protect his rights, the serviceman with disability is strongly advised not to leave the camp or hospital and return home before the aforementioned evaluation and determination are made. Application for suspension of services should be considered carefully and thoroughly because “suspension of military services requires the consent from both the disabled serviceman and his family as well as an affidavit.” Once military services are suspended, the right to allowance and home care will extinguish, and the unfulfilled military services need to be resumed when the serviceman is fully recovered.
If the serviceman voluntarily leaves hospital earlier than the scheduled hospitalization period to seek other medical treatment, he should fill out and sign an affidavit and bear all subsequent medical expenses.


II.Rights of family members
Poor families which have the right to receive Class A, Class B and Class C living allowance: “one lump sum household allowance” and “Three Major Holiday Benefits” for Chinese New Year, Dragon Boat Festival and Moon Festival shall be paid. “Special allowance” may be applied every three months if living allowance is not sufficient to maintain an affordable life.
When the spouse of a serviceman gives birth, the serviceman may apply for “childbirth subsidy.” A serviceman may apply for “death subsidy” when his spouse or lineal relative by blood passes away. If the family of a serviceman suffers major disaster, he may apply for “disaster relief fund.” When a serviceman seeks medical care or is hospitalized, he may apply for “medical subsidy.”


III.Rights of the survivals in the family of dead military serviceman
(1)The Ministry of National Defense pays consolation payment as well as insurance payment according to the category of pension. Taipei City Government pays one lump sum special allowance and funeral expenses.
(2)Where a serviceman is killed in the battle field or dead from injury or illness as a result of performing his official duties and the survivals in his family are already in the category of assistance, Class A living allowance should be paid during the pension collection period. In the event that the family financial status of those who have not received living allowance turns in distress, they may apply for assistance.
(3)Three Major Holiday Benefits for Chinese New Year, Dragon Boat Festival and Moon Festival will be given to the survivals in the family of dead military servicemen (Rank of Capitan and below).


IV.Management of reserve soldiers
(1)Call-to-Service – complete all local government related call-to-service affairs pursuant to the Enforcement Rules of the Act of Military Service System, Regulations Governing the Military Array and the programs of the Ministry of Interior and the Ministry of National Defense.
(2)Deferred call – undertake deferred call of reserve soldiers within the stipulated time set forth in the annual implementation program of deferred call, undertake deferred call, sequential and last call application made by reserve soldiers according to the stipulated time, complete preliminary review, re-examination, submission of statistics and recording of performance registration.
(3)Management of reserve soldiers – conduct reserve soldiers’ reporting of return back home, administration, investigation and control of incident, revision of military register data, retirement as well as submission of evaluation statistics according to the Regulations Governing the Management of Reserve Soldiers.
(4)Grouping of reserve soldiers – review, allocate and audit funds set aside for reserve soldier counseling service programs by district and village of Taipei City. The services include: organizing social activities for reserve soldiers in the district and village, fully mobilizing reserve soldiers, stabilizing the society and assisting in rescue efforts in natural disasters and disaster prevention promotion, policy promotion.
(5)Convenient public services
● Fully implement services for military dependents’ village and take care of single veterans: services for Taipei’s military dependents’ villages and single veterans started from March 2007. The Department contacts all military dependents’ villages by phone and attends the meetings of community management committee or community meetings. The Department expresses the sincerest respect on behalf of the Mayor and participates in the discussion of proposals for community development. If there is any proposal, the Department will collect and compile detailed information, and send the information to the relevant authority by letter to request assistance.
● If a case of deferred call is officially listed and it is verified that an extension of time applies to the case, the Department will take initiative not only to notify the case subject by phone, but also notify the case subject by letter of making application for future reference.
● Publicly announce the legal elements of deferred calls, and request all district offices by letter to promote these elements by ways of village meeting, media and the Internet.
● In order to provide convenient services, reserve soldiers who agree to retire from military and report their return back home are allowed to use signature rather than seal if they forget to bring their seal.
● Receive application for “Annual Physical Examination for Service Exemption and Military Category Transfer of Reserve Soldiers” from reserve soldiers. The Department shall review and approve the application based on the standards of categories of physical status.” Regardless of being approved or not, the Department shall notify the applying soldiers pursuant to the physical examination register approved by the Reserve Command. If an applicant has serious illness (injury), and cannot be escorted or has safety concern, he may be notified to stay at home for special case investigation.
● In the event that a reserve soldier has excellent performance during call-to-service or special contribution to the country, society or management, constitution, training, mobilization of reserve soldiers and crime prevention, or devotes himself to public good with specific achievement, the Department may compile the information jointly with the Reserve Command, and submit the said information to the Ministry of National Defense for rank conferral approval. The rank conferral ceremony shall be personally hosted by the Chief of the General Staff.
● In the past, if a reserve soldier applied for deferred call according to Subparagraphs 4 and 5 of Paragraph 1 of Article 41 of the Act of Military Service System, he had to submit a complete household certificate transcript which recorded his parent’s marriage and completion of household registration, movement, alteration, separation of household and marriage by sisters until now. Since it dated back to a long time, it was very difficult to successfully apply for a complete household certificate transcript of this kind. In order to ensure the rights of military servicemen, only the current household certificate transcript (including the household certificate transcript of the father) is required. Since April 2000, household certificate transcripts are provided by government agencies for the purpose of providing convenient services for people.
● The Department takes initiative to ask and investigate whether reserve soldiers who retire from military and report their return to home intend to seek employment or receive vocational training. The Department will provide information on employment and vocational training based on the needs of reserve soldiers, and assist in offering recommendation and matching services so as to assist reserve soldiers.
● The physical status of a serviceman whose military service is suspended shall be subject to assessment once a month. He is then transferred to different military category, exempted from military service or retires according to the above assessment. In addition, according to Article 20 of the Act of Military Service System, where a standing or replacement soldier whose military service is suspended due to illness during his stay in the camp has recovered from the illness, he should return to military service. If national defense is not affected, the said serviceman may be exempted from return to service.
● All training and roll-call mobilization orders for reserve soldiers are now delivered by post in order to reduce the burden of the police.


V.Management of National Guard
(1)National Guard to be trained: draftees borne before 1980 who are judged as Category C Physical Status should be listed and managed as National Guard. At present, conscription and training of the National Guard are suspended. Application for National Guard Identification may be made.
(2)Reminders of replacement and renewal of the National Guard military service certificate: apply to the section of compulsory military service of the district office in the place of household registration by completing an application form and bringing the identification card and personal seal.
(3)Exit of National Guard: in the event that a national guard intends to exit Taiwan, he needs to make application in advance by submitting the National Guard military service certificate. In the absence of the National Guard military service certificate, a national guard may apply to the section of compulsory military service of the district office in the place of household registration for a temporary certificate.


VI.Management of military cemetery
Where a serviceman or veteran passes away, application for settlement in the City’s military cemetery may be made. The settlement area is for cremated remains. If the application for settlement is approved, the settlement is in principle in the form of cremated remains. In order for the survivals of the family and friends of the deceased serviceman or veteran to worship the deceased, settlement of cremated remains and worship services in martyrs memorials are open between 8:30 and 16:30 every day (except from the 1st to 4th day of the Chinese New Year and days when offices are closed due to natural disaster announced by the government).

VII.Other – coordinate the national defense force to support disaster prevention or relief
(1)Coordinate with the Taipei City Fire Department to execute the annual cross-district disaster prevention & rescue and flood prevention drill, and participate in the drill with the Taipei City Reserve Command and the 202 Military Police Command.
(2)Dispatch personnel to the City Emergency Operation Center to coordinate the national defense force to support disaster prevention or relief after receiving notification of the establishment of Level I Emergency Operation Center from the Taipei City Fire Department.
